Анотація
Мета досліджень – розгляд стану розроблення та обґрунтування положень щодо подальшого оновлення та удосконалення системи затвердження типу сільськогосподарських і лісогосподарських транспортних засобів і їхніх компонентів на основі чинних сучасних актів Європейського Союзу (далі – ЄС) [Regulation (EU) 167/2013, 2013, Commission Delegated Regulation (EU) 2015/208, 2015;
Commission Delegated Regulation (EU) 2015/68, 2015; Commission Delegated Regulation (EU)
№ 1322/2014, 2014; Commission Implementing Regulation (EU) 2015/504, 2015; Commission Delegated Regulation (EU) 2018/985, 2018].
Методи дослідження полягають у вивченні, аналізуванні, порівнянні, оцінюванні, узагальненні та систематизації даних щодо правових і технічних основ вітчизняного та європейського законодавства у сфері оцінки та підтвердження відповідності (затвердженні типу) сільськогосподарських і лісогосподарських транспортних засобів.
Результати. Обґрунтовано необхідність розроблення оновленої системи затвердження типу на основі чинних сучасних законодавчих актів ЄС у секторі сільськогосподарських і лісогосподарських транспортних засобів, визначено основні напрямки й аспекти оновлення нормативно-правових актів, наведено інформацію щодо стану розроблення проектів національних нормативно-правових актів (далі – НПА), розглянуто етапи подальших робіт із доопрацювання та прийняття НПА, окреслено проблемні питання імплементації в Україні європейських правових і технічних основ системи затвердження типу та надано пропозиції щодо їхнього вирішення.
Висновок. Реалізація результатів досліджень уможливить запровадження в Україні актуальної європейської моделі введення в обіг і надання на ринку сільськогосподарських і лісогосподарських транспортних засобів, які відповідають європейським стандартам. У зв’язку з отриманням Україною статусу кандидата до вступу в ЄС необхідність оновлення технічного законодавства України у зазначеній сфері набуває подальшої актуальності. Урахування та впровадження оновлених європейських норм спрямовано на підвищення безпечності, зокрема екологічної, ефективності, конкурентоспроможності вітчизняної сільськогосподарської техніки, створення умов для розширення ринків її збуту.
Розроблення та введення в дію оновлених НПА також буде сприяти усуненню технічних бар’єрів у торгівлі зазначеною технікою, захисту ринку України від ввезення небезпечних і неякісних транспортних засобів та створенню передумов для взаємного визнання результатів затвердження типу між країнами ЄС і Україною.

Summary
The purpose of the research is consideration of the state of development and justification of the provisions regarding the further updating and improvement of the system of approval of the type of agricultural and forestry vehicles and their components based on the current current acts of the European Union
The purpose of research is to substantiate the provisions regarding the further updating and improvement of the type approval system of agricultural and forestry vehicles and their components based on actual acts of the European Union (hereinafter - EU) [Regulation (EU) 167/2013, 2013, Commission Delegated Regulation (EU) 2015/208, 2015; Commission Delegated Regulation (EU) 2015/68, 2015; Commission Delegated Regulation (EU) No. 1322/2014, 2014; Commission Implementing Regulation (EU) 2015/504, 2015; Commission Delegated Regulation (EU) 2018/985, 2018].
Research methods consist in studying, analysing, comparing, evaluating, summarizing and systematizing data on the legal and technical bases of domestic and European legislation in the field of assessment and confirmation of conformity (type approval) of agricultural and forestry vehicles.
Research results. Necessity to develop an updated of type approval system based on the actual EU legislation in the sector of agricultural and forestry vehicles is substantiated, the main directions and aspects of updating regulatory legal acts are defined. Information is provided on the state of development of draft national regulatory legal acts (hereinafter - NPA), the stages of further work on the finalization and adoption of the NPA were considered, the problematic issues of the implementation of the European legal and technical foundations of the type approval system in Ukraine were outlined, and suggestions for their solution were provided.
Conclusions. The implementation of research results will make it possible to introduce in Ukraine the current European model of placing on the market and entry into service of agricultural and forestry vehicles that meet European standards. Ukraine’s acquisition of the status of a candidate for joining the EU makes the need to update Ukraine’s technical legislation in this area even more important. Taking into account and implementing updated European standards is aimed at increasing the safety, including environmental safety, efficiency, competitiveness of domestic agricultural machinery, creating conditions for the expansion of its sales markets.
The development and implementation of the updated NPAs will also contribute to the elimination of technical barriers in the trade of the specified equipment, the protection of the Ukrainian market from the import of dangerous and low-quality vehicles, and the creation of prerequisites for mutual recognition of the results of type approval between the EU countries and Ukraine.
